Finding the right bankruptcy lawyer can be a simple task if you understand what qualities you need. The following tips are intended as a guide to researching and interviewing potential attorneys.


He or She Should Be Clear and Concise


Your bankruptcy lawyer should know what questions to ask you. Really listen to the answers. Pay attention not just to the words that a client uses, but also to his voice, tone, and body language.


Be open with your client and explain things thoroughly. Ask more questions to make sure your explanations are understood. Pay attention to both verbal and non-verbal language to determine understanding. If you think there is doubt, go over it again. Understand that when clients are in an emotional state, it is more difficult for them to understand a complex information.


In some jurisdictions, the formulation of concepts in legal documents can be quite complex At first one is writing about the buyer, then the name of the buyer, then the subsidiary of the buyer – it is important to make sure that when someone who did not draft the document reads it at a later date, the concepts, parties and goals contained in the document are easily understood.  This is especially true when the reader comes from a different lingual/cultural background. Avoid the use of ‘legalese’ or Latin terminology; while it might impress the reader due to its formal tone, there is a high likelihood that the meaning may not be understood.

When it comes to leadership and good judgment, we can look at two subsets of values: those that guide someone towards acting to pursue their own individual interest, and those that guide someone more towards pursuing collective interest.

Many people think that lawyers need to be combative, which is true for litigators, but litigation should be a very small part of what you deal with in business. If it is a large part, you have the wrong law firm or wrong lawyer or you may even be a bad person, which falls outside of my expertise to remedy.Anybody can go to court; but it takes real skill to play nicely with others and negotiate. It is of the essence to have a bankruptcy lawyer who can work with people and who knows what to say, when to say it, or even whether to say it.

Check the attorney’s history using online searches and government sources. Make sure the lawyer has a license in good standing. During a preliminary, in-person meeting, think about whether the lawyer and you will mesh well, and ask candid questions about the lawyer’s background in debt collection litigation.
